(i) These terms and conditions (“Terms”) set out the basis upon which (“Users”, “you”, “your”) can access and use the Website by way of a computer system (including social media platforms Snapchat/Facebook/Instagram/Tiktok), mobile device or through an application provided by It’s Luxury to browse and order watches, jewellery, leather, accessories and other items (“Product(s)”).

 

(ii) By accessing the Website, you agree to be bound by these Terms. If you do not agree with any of the Terms, your sole recourse is to stop using the Website.

(ii) We grant you a personal and limited right to access and use our Website and IP materials, for the sole purpose of letting you, the user, use and enjoy the benefits of the Website for a personal non-commercial use as permitted by these Terms and our other policies.

(iv) We, together with our licensors expressly reserve all intellectual property rights in all text, programs, products, processes, technology, content, and other materials, which appear on the Website. (v) The Company reserves the right to refuse access to the Website, terminate accounts, remove, or edit content, or cancel orders at Company’s discretion. If the Company cancels an order, it will be without charge to you.

 

Orders

 

(i) When you place an order for Products, the Company collects certain personal and transactional information (e.g. name, address, email address). The use of your information is detailed in the Privacy Policy. 

 

(ii) The products are subject to availability. If, for any reason beyond our reasonable control, we are unable to supply a particular item, we will inform you as soon as possible, and refund/re-credit you for any sum that has been paid by you or debited from your credit card for the products.

 

(iii) Kuwait: The customer has the right to exchange or return the product and get a refund as per Kuwaiti law. For more details please see the policy details.

KSA: The exchange and return policy is a set of rules and laws set by the company, through which the method of dealing with returns is clarified, as per Consumer Protection Authority. For more details please see the policy details.

 

(iv) We reserve the right to refuse or cancel an order for any reason, including limitations on quantities available for purchase, inaccuracies, or errors in product or pricing information, or any other problem identified by us.

 

(v) The products are not intended for resale.

 

(vi) By confirming your purchase at the end of the checkout process, you agree to accept and pay the full amount payable for the product(s) as indicated during the checkout. You will receive an email to inform you that your order has been confirmed once payment is confirmed from the payment provider.

 

(vii) The Company accepts orders for Products subject to availability. We may reject your order in a variety of situations, including but not limited to the following:

 

• Saved in wish list/shopping cart but not paid for

• If the item is out of stock

• If we are unable to obtain authorisation for your payment

(i) The Company is not the manufacturer of the Products sold via the Website. We do our best to ensure that the information provided on the Website is accurate, complete, reliable, and current, but we do not warrant that it is error-free. (ii) The Company has made every effort to display the colours, specifications, and dimensions of Products on the Website as accurately as possible. The colours you see will depend on the resolution of your monitor; the Company cannot guarantee that your monitor's display of any colour will reflect accurately the colour of the Product delivered. The Company may from time to time vary the dimensions, specifications, and quantities of Products displayed on the Website without prior notice.

Prices

 

(i) Prices on the Kuwait store are displayed in KD (Kuwaiti Dinar) and exclude any services you may elect to pair the purchase with, delivery costs, taxes or duties to which the purchase may be subject. Any such additional costs will be displayed before your final check out.

 

(ii)Prices on the Saudi store are displayed in SAR (Saudi Riyal), including VAT of 15%, and exclude any services you may elect to pair the purchase with, delivery costs, taxes, or duties to which the purchase may be subject. Any such additional costs will be displayed before your final checkout. VAT-included prices will be displayed throughout the website.

 

(iii) All prices are subject to change without notice. Prices may change at any time due to markdowns or price changes advised by the manufacturer. These price changes can reflect at any time throughout the day and may result in the price of a Product increasing or decreasing. These markdowns can be permanent or temporary, and any changes in prices are at the discretion of the Company and are in line with pricing guidelines by the manufacturer.

Home Delivery

 

 

(i) Through www.itsluxury.com/kw_en or www.itsluxury.com/kw_ar we deliver the respective brands available on the local store only in Kuwait. For Saudi Arabia, the brands we deliver are listed on www.itsluxury.com/sa_en & www.itsluxury.com/sa_ar. 

 

(ii) Deliveries take place between 9:00 AM To 7:00 PM. 

 

(iii) Orders are processed and delivered on working days, between Saturday and Thursday, excluding public holidays*. 

 

(iv) Orders placed outside working hours/days, after the cut-off time and/or during any KSA or Kuwait public holidays, respectively, will be deemed placed on the first local working day following the Order's submission. 

 

(v) Delivery timelines are estimated. We are not responsible for failures or delays to deliver for reasons outside our reasonable control, including weather conditions, availability to receive the delivery, incorrect contact details (address and/or phone number) provided, or postponement requests.

 

(vi) Order delivery may face delays during promotional activity, sale season, and public holidays.

 

(vii) Once your order is ready for delivery, our local delivery provider will contact you to schedule the date/hour of the delivery at your convenience.

 

(ix) For some orders, at our discretion or as per the legal requirements in the country, we will require a copy of your local National ID upon delivery. 

 

Delivery Process

 

If there is no one at the address given who is able and competent to accept delivery of the products, you will have the option to arrange for an alternative delivery date or be given additional information about the collection of the products. We will make three attempts to deliver the order before canceling it and refunding your payment.

Refund Process

 

 

(i) Refunds will only be processed after completing the Return Process and the item/s returned have been reviewed and approved by our experts in-stores. After approval, we will issue a refund of the full-face value of undamaged items duly returned.

 

(ii) Your refund will be processed within 5-15 working days via the following methods:

 

• Credit/Debit Card / Mada payments are refunded back to the card used in the purchase

• Tabby payments are refunded as per the provider’s process.

 

Damaged/Defected Item Returns:

Exchanges:

 

We are not currently able to offer Exchanges. Instead, all items should follow the returns process, and a new Order may be placed for the replacement items.

User/Company Rights

 

(i) Trafalgar General Trading Company in Kuwait & United Luxury Company in the Kingdom of Saudi Arabia has the right to refuse to replace or refund any items if the following conditions apply:

 

• If the returned item is missing any part, materials, machinery, or any other material required according to its nature or non-original condition

• If the item is damaged due to misuse or general wear and tear, or in a state or malfunction and is not in sellable condition

• Engraved item, made to measure and special orders

• Customer return history trend and frequency (the local consumer protection laws may take precedence in this situation, based on the online store the order is attempted from)

 

(ii) Trafalgar General Trading Company strives to protect the interests of the customer according to the laws and conditions applicable in Kuwait and our affiliate United Luxury Company applies the same in the Kingdom of Saudi Arabia.

 

Counterfeit

 

All products sold on It’s Luxury by Trafalgar are 100% authentic as the authorised e-retailer for the listed brands in the respective regions. 

 

Products Warranty

 

Certain products may benefit from manufacturer's warranty. If that is the case, it is outlined on the product page of the respective Product.  For such products, the warranty will be activated, and the relevant documents will be delivered with your order.

Unless These Website Terms are governed by Kuwait Law and all disputes arising here are subject to the exclusive jurisdiction of the Courts of Kuwait. If any portion of the Terms is held to be unenforceable, invalid, or illegal by any court of competent jurisdiction, the remainder of the Terms shall not be affected.

These Website Terms are published in English and Arabic. If there is any inconsistency between the English text and the Arabic text, the English text will prevail.

 

Relationship & Notice 

 

(i) None of the provisions of these Terms will be deemed to constitute a partnership or agency between you and Company and you will have no authority to bind the Company in any manner whatsoever.

 

(ii) Except as explicitly stated otherwise, any notices to the Company from you will be given by email to provide under Contact Section with a physical copy sent to Company by mail or courier, such notice deemed given on confirmation of its receipt to you by the Company by return email. Any notices to you from the Company will be given by notices posted on the Website or by email to the email address you provide to Company during the registration process and will be deemed to be received by you 48 hours after any such email is sent. Alternatively, the Company may give you notice by mail or prepaid shipping to the address provided to the Company during the registration process. In such case, notice will be deemed given 7 days after the date of mailing.
