1. Who we are and what this Policy covers
1.1 This Privacy Policy (the "Policy") is issued by United Luxury Corp, a company incorporated under the laws of the Kingdom of Saudi Arabia whose Tax Registration Number (TRN) is 301253172100003, whose registered office is at Building 279, King AbdulAziz Road, Sulaimaniah District, Riyadh 11578, Kingdom of Saudi Arabia, P.O. Box 75056, trading as It's Luxury (the "Company", "we", "us" or "our"). It applies to the personal information of each person (the "Customer", "you" or "your") who uses the website at itsluxury.com (Saudi Arabia store) (the "Website"), contacts us by telephone, email, WhatsApp or live chat, or visits our boutiques in the Kingdom of Saudi Arabia.
1.2 This Policy forms part of the Terms and Conditions published on the Website and describes how and why we collect, store, use and share personal information, and the rights you have in respect of it. It is drawn up in accordance with the Personal Data Protection Law of the Kingdom of Saudi Arabia issued by Royal Decree No. M/19 dated 9/2/1443H, as amended by Royal Decree No. M/148 dated 5/9/1444H, and its Implementing Regulations (the "PDPL").
1.3 The Website is not directed at children. A person who has not attained the age of majority stated in the Terms and Conditions may not register an account or place an order, and we do not knowingly collect personal information from children.
2. Consent and lawful basis
2.1 By using the Website you consent to the collection, use and disclosure of your personal information in accordance with this Policy. You may withdraw your consent at any time by contacting us under Clause 12; withdrawal does not affect the lawfulness of processing carried out before it, or processing for which we have another lawful basis.
2.2 We process personal information only (a) where it is necessary for the performance of a contract with you, including processing and delivering an order; (b) where it is necessary for our legitimate interests or those of a third party, namely auditing the use of the Website, responding to enquiries and providing our services, and administering promotions and events in which you take part; (c) where you have given consent, including for the marketing described in Clause 8; and (d) where processing is required by law, including responding to lawful requests by government or law enforcement authorities and complying with applicable legislation.
3. The information we collect
3.1 Information you give us. When you enquire about or use our services, register an account, place an order, or correspond with us by telephone, email, WhatsApp, live chat, in writing or in person in our boutiques, we may collect your name, email address, home and shipping address, telephone number, national identity document details, gender, date of birth, and the details of your orders, including the time and date of purchase.
3.2 Information we collect automatically. On each visit to the Website we may collect technical information, including the Internet protocol (IP) address used to connect your device, browser type and version, time zone setting, browser plug-in types and versions and operating system, and information about your visit, including the products you viewed or searched for, page response times, download errors, length of visit and page interaction information such as scrolling and clicks.
3.3 Information we receive from other sources. We may receive information about you from our authorised business partners and service providers, including delivery and payment partners engaged in fulfilling your order.
3.4 Live chat. Where a live chat feature is offered, we may record and store chat conversations. Transcripts are accessed for customer service purposes only.
4. How we use personal information
4.1 We use personal information to conclude, perform and record contracts of sale, including processing payment, arranging delivery and providing warranty and after-sales service; to operate, secure and improve the Website; to respond to enquiries and complaints; to administer promotions and events; to send the communications described in Clause 8 where you have consented; and to comply with our legal obligations.
5. Sharing personal information
5.1 We share personal information with service providers, business partners and affiliated companies engaged in our business activity who perform services on our behalf, namely payment processing (including card acquirers and the instalment payment providers offered at checkout), information technology and Website maintenance, surveys and market research, warehousing and logistics, couriers and delivery partners, advertising and marketing, and any service required to process your order or in relation to its warranty. We also share personal information with our legal, audit, financial and insurance advisers.
5.2 We may also disclose personal information (a) if we sell or buy any business or assets, to the prospective seller or buyer; (b) if the Company or its assets are acquired, as one of the transferred assets; (c) where we are under a duty to disclose it to comply with a legal obligation or legal process, to enforce or apply our terms and agreements, or to protect the rights, property or safety of the Company, our customers or others; and (d) for the purposes of crime prevention and fraud protection.
5.3 We may disclose personal information to law enforcement authorities and other government officials, and to any competent administrative or judicial authority, in accordance with applicable anti-money-laundering and counter-terrorist-financing regulation, for the purposes of preventing money laundering or terrorism financing.
6. International transfers
6.1 Your personal information may be transferred to and stored on servers and facilities located in your region or in another country. Some of those countries may not provide the same level of data protection as the Kingdom of Saudi Arabia. Where we transfer personal information to another country we use, share and safeguard it as described in this Policy, and we do so in accordance with the PDPL and the Regulation on Personal Data Transfer outside the Kingdom, including by transferring only with your consent, where it is necessary for the services we provide to you, or subject to appropriate safeguards.
7. Cookies and internet advertising
7.1 We use cookies, which are small files sent to your device's storage by a web server, to make the Website work and to improve it. Information from cookies may include information about your use of the Website, your device (such as IP address and browser type) and demographic data. Most browsers can notify you when you receive a new cookie and let you reject or disable cookies; disabling cookies may affect parts of the Website.
7.2 The cookies we use are, broadly: (a) authentication cookies that let you log in and reach restricted areas, deleted when you close your browser; (b) session cookies, deleted when you close your browser; (c) preference cookies that remember selections such as your country or store choice across visits, which expire after a set time; (d) cookies that recognise repeat visitors for statistical and analytical purposes; (e) cookies that personalise your experience, such as your basket contents, language or location; (f) cookies that measure the effectiveness of advertising campaigns and limit how often you see an advertisement; (g) cookies that manage your account; and (h) cookies used for marketing, including newsletters and re-marketing advertisements, subject to your marketing choices under Clause 8.
7.3 We also use advertising identifiers, found on many mobile devices and tablets, which work like cookies and are used with information about your use of this and other websites and apps and your response to advertisements and emails to deliver advertising that is more relevant to you.
8. Marketing communications
8.1 We, or trusted third parties on our behalf, may contact you by email or other channels with information about our products, services and promotions where you have consented to receive them. At the time you provide your personal information you are given the opportunity to indicate your marketing choices.
8.2 You may withdraw your consent to marketing at any time by using the unsubscribe link in any marketing email or by contacting us at customercare@itsluxury.com. Withdrawal of marketing consent does not affect the processing of personal information needed to provide our services.
9. Security
9.1 We hold personal information securely in electronic and physical form and apply physical, electronic and managerial procedures, including up-to-date storage and encryption standards, to protect it against unauthorised access, improper use or disclosure, unauthorised modification, unlawful destruction and accidental loss. Payment card details are processed through secured payment channels and are not stored, sold, shared, rented or leased to third parties by us. No transmission over the internet is completely secure, and information you transmit by email is sent at your own risk.
10. How long we keep personal information
10.1 We retain personal information for the length of time needed to fulfil the purposes set out in this Policy, unless a longer retention period is required or permitted by law, including tax, accounting and anti-money-laundering requirements.
10.2 Personal information processed for marketing is kept until you withdraw your consent. Once you do, it is kept only for the applicable limitation period for any dispute or liability that may arise from the processing under the laws of the Kingdom of Saudi Arabia, and is then deleted.
11. Your rights
11.1 In accordance with the PDPL you have the right to be informed of how we collect and process your personal information; to ask us for a copy of the personal information we hold about you in a clear and readable format; to have inaccurate or incomplete personal information corrected, completed or updated; and to ask for personal information that is no longer needed to be destroyed. We respond to requests within the period prescribed by the PDPL and its Implementing Regulations.
11.2 To exercise any of these rights, contact us at customercare@itsluxury.com. We shall correct, update or remove personal information as swiftly as reasonably possible. We may need to verify your identity before acting on a request, and we may retain information we are required by law to keep.
12. Third-party websites
12.1 The Website may link to unaffiliated third-party websites. We do not control and are not responsible for their content or their privacy practices. You should review the privacy policy of any third-party website you visit.
13. Changes to this Policy
13.1 We may amend this Policy from time to time by publishing the amended Policy on this page, and the amended Policy takes effect when published. Please check this page regularly.
